Who Is Considered a Refugee?

A refugee is a person who has been forced to leave their country of origin or nationality due to a reasonable fear of persecution. This fear must be based on one or more of the following grounds:

What Is a Refugee Claim?

A refugee claim is a formal request for asylum made in Canada by an individual who believes they would face persecution, danger, or serious harm if returned to their country of origin or habitual residence.

The purpose of a refugee claim is to determine whether the applicant qualifies for refugee protection under Canadian law and international agreements signed by Canada. Each claim is carefully assessed based on evidence, credibility, and legal criteria.

Refugee Protection in Canada

The Immigration and Refugee Board of Canada (IRB) grants refugee protection to individuals who qualify under one of the following categories:

Convention Refugee

Under Section 96 of the Immigration and Refugee Protection Act (IRPA), a Convention Refugee is a person who meets the following conditions:

Grounds of Persecution

The individual has a well-founded fear of persecution based on:

Outside Country of Nationality

The person must be outside their country of nationality and unable or unwilling to seek protection from that country due to fear of persecution.

Stateless Individuals

If the person has no nationality, they must be outside their country of former habitual residence and unable or unwilling to return because of persecution.

Person in Need of Protection

A Person in Need of Protection, as defined under Section 97(1) of IRPA, is an individual physically present in Canada who would face serious danger if returned to their country.

Refugee Programs in Canada

Canada provides structured refugee programs offering protection, resettlement, and long-term support.

Government-Assisted Refugees (GAR)

Government supports UNHCR-referred refugees financially for up to one year.

Privately Sponsored Refugees (PSR)

Private sponsors provide financial, emotional, and settlement support during sponsorship.

Blended Visa Office-Referred (BVOR)

Shared government and private sponsorship provides financial aid and settlement support.

Joint Assistance Sponsorship (JAS)
